1. Acceptance of Terms

By creating an account and using the VolleyScreen platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of the Service

VolleyScreen is a software-as-a-service ("SaaS") platform for sports performance and clinical monitoring of volleyball athletes. The Service provides:

The Service is intended exclusively for use by qualified clinical and performance professionals working with volleyball athletes (physiotherapists, sports physicians, sports scientists, performance coaches, athletic trainers). The Service is not intended for self-use by athletes without professional supervision.

4. Account Registration

To use the Service, you must:

  1. Be a qualified clinical or performance professional, or be authorised by such a professional to use the Service on their behalf
  2. Provide accurate, current, and complete information during registration
  3. Maintain the security of your account credentials
  4. Notify the Provider immediately of any unauthorised access to your account
  5. Be at least 18 years of age

The Provider reserves the right to suspend or terminate accounts that violate these Terms or that contain inaccurate registration information.

5. Subscription Plans and Billing

The Service is licensed on an annual, per-athlete basis. A licence reserves one slot for one simultaneously active athlete; archiving an athlete frees the slot for another. Each licence is valid for 12 months from activation.

Prices are in Brazilian Reais (BRL) and exclude any applicable taxes (ISS, etc.), which will be added at checkout where required. Billing is processed by Asaas, a payment provider established in Brazil. An annual licence is charged once per 12-month period; athletes added mid-term are prorated to the remaining period and co-terminate with it. Licences are not refunded for athletes archived before the end of the period.

During the pilot phase, access is granted on request (see "Request access" on the landing page). The Provider may modify pricing with at least 30 days of notice to active licence holders. Continued use after the notice period constitutes acceptance of the new pricing.

6. Acceptable Use

You agree not to:

  1. Use the Service for any unlawful purpose
  2. Attempt to gain unauthorised access to other users' accounts or to the Provider's infrastructure
  3. Resell, sublicense, or redistribute the Service without written authorisation
  4. Use automated tools to scrape or extract data beyond the documented APIs
  5. Upload data of athletes who have not provided informed consent for processing through the Service (see the Privacy Policy)
  6. Use the Service to make autonomous clinical decisions without professional review (see Section 7)

7. Clinical Disclaimer

The Service is a decision-support tool for qualified clinical professionals. It is not a medical device and does not provide diagnosis, treatment, prediction, or autonomous clinical recommendations.

Visual signals (coloured indicators) presented by the Service represent detection of deviations from each athlete's personal baseline. They do not classify athletes as "at risk of injury" and do not predict future events. Final clinical interpretation and decision-making is the exclusive responsibility of the qualified professional supervising the athlete.

The Provider does not assume liability for clinical decisions made by users of the Service, whether or not such decisions were informed by the Service's output.

8. Intellectual Property

The Service, including its source code, design, documentation, and trademark "VolleyScreen", is the exclusive intellectual property of the Provider.

Data entered by users (athlete records, clinical notes, training logs) remains the property of the user or the user's organisation. The Provider receives a limited licence to process such data exclusively for the purposes of providing the Service, as described in the Privacy Policy.

9. Third-Party Integrations

The Service integrates with third-party platforms (Polar, Oura, Garmin, Anthropic, Asaas). Use of such integrations is subject to the respective third-party terms of service. The Provider is not responsible for the availability, accuracy, or behaviour of third-party integrations.

10. Service Availability

The Provider strives to maintain Service availability of at least 99% per calendar month, excluding scheduled maintenance announced in advance and events outside of the Provider's reasonable control (force majeure, third-party infrastructure outages).

The Provider does not guarantee uninterrupted or error-free operation.

11. Limitation of Liability

To the maximum extent permitted by applicable law, the Provider's total liability arising from or related to these Terms or the Service is limited to the amount paid by the user to the Provider in the 12 months preceding the event giving rise to liability.

The Provider is not liable for indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruption.

This limitation does not apply to liability that cannot be excluded under applicable law (gross negligence, wilful misconduct, personal injury caused by the Provider).

12. Termination

The user may terminate the account at any time by emailing the Provider. Upon termination, the user's data is retained or deleted according to the Privacy Policy.

The Provider may terminate or suspend the user's account, with reasonable notice when possible, in case of:

  1. Material breach of these Terms
  2. Non-payment of subscription fees
  3. Use of the Service in a manner that risks harm to athletes or third parties
  4. Discontinuation of the Service (with at least 90 days of notice and a reasonable opportunity to export data)

13. Modifications to the Terms

The Provider may modify these Terms with at least 30 days of notice to active users. Continued use of the Service after the notice period constitutes acceptance of the modified Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Brazil. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of the District of Jacareí, São Paulo, Brazil — except where mandatory consumer protection laws of the user's country of residence provide a different forum.
